By using the Match Fishing service and all associated pages and services on the www.matchfishing.hr domain, it is considered that consumers are at all times familiar with these Terms of Sale (hereinafter: Terms), and that they fully understand and accept them. 2. TERMS OF SALE for contracts concluded outside business premises and contracts concluded at a distance

- this includes orders made through the Match Fishing web store, by phone, fax or in writing with the selected delivery to the customer's address.

I) Conclusion and termination of sales contracts concluded outside business premises and contracts concluded at a distance

These Terms and Conditions as well as individual terms of sale indicated with information about specific products represent Match Fishing's offer to enter into an Agreement, and the user as a customer by registering, concluding an order or in any other way determined by these Terms and Conditions accepts the same, which is considered to require the conclusion of an Agreement between users and Match Fishing, and according to the conditions of sale specified in these Terms.
The subject and commercial purpose of the Agreement is the purchase of a selected product or service through the Match Fishing web store with payment of the appropriate fee - the price of that product or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: printed promotional messages with purchase order, telephone with and without human mediation, and the Internet.
The contract comes into force and is binding from the moment the user takes over the account and the goods. If the customer collects the ordered goods in the physical branches of Match Fishing, in that case it is not a contract concluded outside the business premises and a contract concluded at a distance, because the customer can clearly convince himself of the main features of the goods or services before making the purchase, and if desired to give up the final purchase, i.e. concluding the contract. A previously placed order does not bind him. The contract comes into force and is binding from the moment the user takes over the account and the goods.
The buyer has shown his intention to enter into a sales contract:
• by selecting payment and completing the order as a registered user of Match Fishing,
• by selecting payment and completing the order as a guest user of Match Fishing,
• by selecting payment and completing the order via the phone lines of Match Fishing branches

The contract enters into force and becomes binding as soon as Match Fishing confirms the availability and price of the goods and, depending on the payment method, authorizes payment by card, sends an official guaranteeing offer for payment by wire transfer or sends the customer an invoice and a notification about the time of sending the shipment. The contract does not come into force upon placing the order itself and receiving an automated message about the order being placed by the Match Fishing web shop system, because the availability, price or specifications of the goods may change at the time the order is placed. Only an official binding offer or the issuance of an invoice confirms the price and availability of the goods.

a) In the process of registering or creating a user account, the user is obliged to choose a name or names under which he will provide services and choose a security password and submit a valid e-mail address. All data required for registration or creation of a user account must be true, and the use or use of other people's data is expressly prohibited.
b) Registration or user account is created only for one person and it is not allowed to communicate information about registration or user account to third parties. The user is obliged to keep information about his security password and user account. The use of someone else's registration or user account is not allowed.
c) For violation of the provisions of the Terms and Conditions from this chapter, Match Fishing reserves the right, at its discretion, to terminate the user's registration or user account, without the obligation to compensate the user for any cost or damage.
d) If the customer chooses to pick up the goods at the Match Fishing branch, the Agreement will come into force after the pick-up and payment of the goods with the issuance of a physical invoice. If the customer chooses one of the Match Fishing branches to pick up the goods and invoice, then it is not a contract concluded outside the business premises or a contract concluded at a distance.
e) If the customer chooses delivery of the goods by courier service, the contract comes into force at the moment when Match Fishing employees deliver the invoice to the customer by e-mail, fax or mail. In this case, it is considered a contract concluded outside the business premises or a contract concluded at a distance.
f) After placing the order (expressed intention of the user to enter into the Agreement), the user will receive a Confirmation of the completed order, i.e. a pre-contractual notification from Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), these Conditions and notification of the user's right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, Paragraphs 1 and 2 of the Consumer Protection Act (this will be delivered via a link if the Confirmation of the completed order is delivered by e-mail or in writing in a separate document if the Confirmation of the completed order is delivered by regular mail or fax).
h) The User can unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. The User does not have the right to unilaterally terminate the Agreement:
- if the service has been fully fulfilled for him, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled for him,
- if the subject of the Agreement is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery,
- if the subject of the Contract is goods which, due to their nature, are inseparably mixed with other things after delivery,
- if the subject of the Agreement is the delivery of sealed audio or video recordings, or computer programs, which were unsealed after delivery, and
- if the subject of the Contract is the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts for such publications.

In order for the user to be able to exercise the right to unilaterally terminate the Agreement, he must notify Match Fishing of his decision to unilaterally terminate the Agreement before the expiration of the term, by an unequivocal statement sent by post (to Optimus Lab doo, Luja Bezeredija 41, 40000 Čakovec, Croatia), by fax to + 385 40 644 025 or by e-mail to shop@matchfishing.hr , in which you will state your first and last name, address, telephone number, fax or e-mail address, and you can also use the written form for unilateral termination of the Agreement.

The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the user or a third person designated by the user, who is not the carrier, or, in the case of a service, from the conclusion of the Agreement.
If the user unilaterally terminates the Agreement, the money received from him will be refunded, without delivery costs, without delay, and no later than within 14 (fourteen) days from the day when Match Fishing, i.e. Match Fishing receives the user's decision on unilateral termination . The refund will be made in the same way the user made the payment. The user is obliged to hand over the goods or send them to the address Optimus Lab doo, Luja Bezeredija 41, 40000 Čakovec, Croatia, without unnecessary delay, and in any case no later than within 14 (fourteen) days from the day when Match Fishing, i.e. Match Fishing- u, submitted its decision on the unilateral termination of the Agreement. The direct costs of returning the goods must be borne by the user himself (HRK 50.00 AND AN ADDITIONAL 50 HRK IF HE DOES NOT RETURN THE GOODS AT HIS COST). The user is requested to call shop@matchfishing.hr before terminating the Agreement so that the procedure for returning the goods can be explained to him.
The user is responsible for any decrease in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
If, at the user's request, the execution of the service began during the term for unilateral termination of the Agreement, the user is obliged to pay Match Fishing an amount that is proportional to what was delivered by the time the user notified Match Fishing of the unilateral termination of the Agreement.

2.1 CONDITIONS OF UNILATERAL TERMINATION OF THE PURCHASE AGREEMENT for contracts concluded within the physical branch of Match Fishing


- this includes goods purchased directly in Match Fishing branches with the physical presence of the customer, i.e. orders made through the Match Fishing web store, by fax or in writing with the chosen pick-up of the ordered goods in Match Fishing branches, or if the customer subsequently decided to pick up the goods in the Match Fishing branch. In these cases, it is not a contract concluded outside the business premises and a contract concluded at a distance, because the customer can clearly convince himself of the main features of the goods or services before making the purchase and, if he wishes, abandon the final purchase, i.e. concluding the contract. The contract comes into force and is binding from the moment the user takes over the account and the goods.

In the event that the merchant has fully fulfilled the contract, and the buyer wants to return the goods for personal reasons, the merchant offers the possibility of returning the goods within 14 days after collection under the following conditions:
1.1. If the buyer returns the unpackaged product in the original packaging, the buyer bears the costs of returning the goods, and the seller will return the entire paid purchase price for the product, without deduction
1.2. If the buyer returns the unpacked product that he has not used and the original packaging, the buyer bears the shipping and handling costs, and the seller will return the paid purchase price for the product minus 15%.
1.3. If the buyer returns the used product with the original packaging, the buyer bears the shipping and handling costs, and the seller will return the paid purchase price for the product minus 25%.
1.4 If the customer returns a physically damaged product, with defects that are not subject to warranty repair (such as failure due to excessive voltage, short circuit, moisture or physical damage and scratches) or a product with significantly damaged packaging, the merchant has the right to refuse the return of the product or offer a return with reduction of the amount at the dealer's discretion. The same applies if the customer returned the product without the issued warranty card, instructions and other accompanying documentation that comes in the packaging
1.5. If the customer ordered a product that was ordered exclusively for him or according to the requested specifications, then there is no possibility of returning the product.
2. The seller determines which category the returned product belongs to after the buyer returns it to him, and the buyer has the right to request documentation based on which the product is categorized (photograph and record of the condition of the received product)
5. In the event that the buyer orders goods and refuses to receive them, the seller has the right to ask the buyer for reimbursement of postal and handling costs.
6. In the case of a product return, the refund will be made after the merchandise has been received by the merchant, and no later than within 30 days of the approval of the refund.
II) Conditions and purchase procedure
The main characteristics of the product, the method of use, prices, special offers and benefits, payment and delivery methods refer to those that are valid at the time the order is placed. The above data will be indicated with each product.
The price of the product, which includes the amount of VAT and the cost of delivery, is visible in the shopping cart before the order is placed. The cost of delivery may also be visible on some other parts of the page. All information about the purchase confirmation based on the electronic order will be delivered to the customer's e-mail address specified in the registration/order process or in the shopping cart when entering data when concluding the order. All prices are expressed in Croatian kuna (HRK). All prices include VAT.
If the customer does not receive the order confirmation notification, there is a possibility that he entered his e-mail address incorrectly. III) Delivery and terms of delivery
• the shipping cost is calculated automatically when you purchase the product and you are issued an invoice with the price of the purchased products and the shipping price
• the cost of delivery will be shown in the shopping cart along with the price of the product
• the cost of delivery in the territory of the Republic of Croatia is fixed and amounts to HRK 25, regardless of the weight, volume or address of the customer
• the delivery term for products, which are stated to be in stock, throughout Croatia is 7 working days from the day the order is placed, except for products with a special note
• in the event of a change in the delivery date or any other important circumstances for the execution of the order, the customer will be notified immediately by our customer service

IV) Complaints and objections
The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. The buyer is obliged to inspect it when taking it over. The buyer is obliged to inspect the packaging of the shipment when taking it over. If the packaging of the shipment has visible damage/flaws, we recommend that the customer refuse to accept it, as there is a possibility that the product inside such packaging is damaged. By refusing receipt, the delivery service will return the shipment to Match Fishing, noting that the shipment contains a defect.
When receiving the shipment, the customer is obliged to check whether he received the corresponding warranty card with it. If the buyer does not complain about not having received the warranty card within 7 days after receiving the shipment, it is considered that there are no complaints about it and that he received it with the shipment.
Complaints related to product defects and all other complaints can be made in writing via electronic or regular mail:

The justification of the complaint and the diagnosis of the failure are carried out by the authorized service listed in the warranty card. In case the authorized service comes to the conclusion that the defect/defect is not covered by the warranty (physical damage, improper use, electric shock...), the customer can decide to pay for the repair or to receive the product back in the same condition. In the case of a justified complaint, the complaint procedure is carried out according to the warranty conditions described in the warranty card. If the delivered goods are damaged and/or defective, the buyer sends the goods with the mandatory attached warranty card and invoice, at the expense of Match Fishing, by courier service Overseas or CityEx. If this is not possible, he is obliged to inform Match Fishing about it in order to arrange an acceptable and safe way of sending the goods for reclamation. Match Fishing collects the advertised damaged, defective or wrongly delivered goods at its own expense, if it is determined that the complaint is justified and that the buyer did not affect the defectiveness, damage or any lack of the goods.
In the event of a dispute regarding the justification of the complaint and/or the manner in which the product was returned, the product will be submitted for expert examination by an expert or a professional legal entity. In the event that the expert opinion determines the justification of the complaint, all the cost of replacing the product will be borne by Match Fishing, and in the case of an unjustified complaint, the cost will be borne by the customer.
V) Warranty for the correctness of the sold products and service
Products for which we provide a guarantee in accordance with the law and the guarantee specified by the manufacturer have a guarantee certificate. The right to use the warranty is realized upon presentation of the invoice and warranty card. The customer is obliged to keep the warranty card and receipt. The date of issue of the invoice is the date of activation of the guarantee. Along with the product description, there is information about the period for which the warranty is provided for a specific product.
In the case of issuing a warranty certificate by which the manufacturer guarantees the correctness of the product during a certain period of time, the customer can, if the product is not correct, demand that the product be repaired within a reasonable period of time (up to 90 days). authorized service listed in the warranty card.
The right to use the guarantee is exercised only upon presentation of the invoice. The customer is obliged to keep the warranty card and receipt. Product malfunction resulting from improper use and/or non-compliance with the instructions is not covered by the warranty. Servicing and sale of replacement parts for the purchased product is provided through the authorized repairers listed in the warranty card.
VI) Method and procedure of payment
Payment of the product price and delivery costs can be made in one of the following ways:
a) Payment by credit or debit card. Ordered products can be paid online with one of these credit cards: American Express, MasterCard, Diners, Visa or Maestro.
b) Payment by general money order. The products for which the order has been concluded can be paid by payment via a general payment slip in all bank branches, FINA or Croatian Post offices. After confirmation of the order, Match Fishing sends by e-mail the data required for payment by general money order. All data must be entered correctly in the general payment form and the payment must be made within the deadline.
c) Payment by internet banking. The products for which the order has been concluded can be paid for via internet banking of any bank where the possibility of such a payment method is open. After confirmation of the order, Match Fishing forwards by e-mail all the necessary data for the execution of the payment.
d) Payment by advance invoice (only for legal entities). Legal entities have the option of paying by advance invoice. After confirming the order, Match Fishing sends a proforma invoice to the customer's e-mail address. After receiving the payment in accordance with the estimate, the delivery process is started.
e) Payment by cash - cash on delivery. When picking up the shipment, the full amount indicated in the invoice is paid to the delivery person, including the cost of delivery.


3. DATA PROTECTION WHEN PURCHASING

Match Fishing undertakes to respect the anonymity and privacy of users of the Match Fishing store and will use and process data exclusively for the purpose and purpose specified in these Terms. Match Fishing may collect personal data of the user, such as name, address, OIB, telephone number or e-mail address only if the user voluntarily submits it to Match Fishing.
Match Fishing will use said data exclusively for the purpose of fulfilling contractual obligations and better insight and understanding of individual needs, habits and requests of users, as well as further development and better provision of all Match Fishing services. Match Fishing collects, processes and publishes data about users related to the way of using the Match Fishing web store without revealing the user's identity and/or personal data that enable the user's identity to be revealed.
Match Fishing collects and records data about the user's IP address (Internet Protocol Address) or about the location of the computer for the purposes of system administration, troubleshooting, content download confirmation or improvement of technical aspects of the Internet service. Match Fishing will automatically record data on the user's usage habits of the Match Fishing web store, including a log file on visits to certain pages and/or content. Such data will be used by Match Fishing exclusively for the purpose of improving its service and adapting and individualizing promotional activities according to the needs of individual users.
