1. GENERAL PROVISIONS OF THE TERMS OF SALE

All rights related to the website www.matchfishing.hr are held by the company Optimus Lab d.o.o. (hereinafter: Match Fishing).
Match Fishing provides sales services through the above website via its service – the Match Fishing Web Shop (hereinafter: Match Fishing).

By using the Match Fishing service and all associated pages and services within the www.matchfishing.hr domain, consumers are deemed to be familiar with these Terms of Sale (hereinafter: the Terms) at all times and to fully understand and accept them. These Terms apply to the rights and obligations relating to the purchase of products or services via the Match Fishing Web Shop and to the rights and obligations arising from the conclusion of a distance sales contract (hereinafter: the Contract) between the consumer as the final buyer and the Match Fishing Web Shop, and they form an integral part of such contracts.

The provider of the online sales service via the Match Fishing Web Shop is Optimus Lab d.o.o., Buzovečka 69, 40000 Čakovec, Croatia.

Users are advised to review these Terms before making a purchase and to check them regularly in order to remain informed of all their rights and obligations.

Match Fishing reserves the right to amend these Terms at any time without prior notice and shall not be liable for any consequences arising from such changes. Changes take effect upon publication on these websites.

Match Fishing reserves the right to discontinue the service and to change the content, as well as other services and subpages that form an integral part of the Match Fishing Web Shop, at any time without prior notice and shall not be liable for any consequences arising from such changes. Match Fishing reserves the right to change, restrict, or terminate the provision of the Match Fishing Web Shop service at any time without prior notice, including partial restriction or complete limitation of access and/or provision of certain services to users who violate the provisions of these Terms and the General Terms of Use.

Use of the Match Fishing Web Shop services is permitted exclusively to adults. Use of Match Fishing by children or minors is not permitted, and parents and/or guardians are responsible for ensuring this; otherwise, they assume all rights and obligations arising from such use, and Match Fishing shall not be liable for any consequences.

Purchased products are used at the customer’s own risk and cannot be considered a substitute for medical or nutritional therapy.

Match Fishing fully disclaims any liability for the accuracy and/or completeness of all information and content published on www.matchfishing.hr. Match Fishing reserves the right to errors in product descriptions and images.

NOTICE:
Product images in the Match Fishing Web Shop are for illustrative purposes. The image illustrating a product on www.matchfishing.hr does not necessarily fully correspond to the actual appearance and contents of the product, and the customer may not file a complaint on this basis.

2. TERMS OF SALE

for contracts concluded outside business premises and distance contracts

  • This category includes orders placed via the Match Fishing Web Shop, by telephone, fax, or in writing, with delivery to the customer’s address selected.

  • This category does not include orders placed via the Match Fishing Web Shop, by telephone, fax, or in writing, with collection of the ordered goods at Match Fishing retail stores selected, or where the customer subsequently decides to collect the goods at a Match Fishing retail store. In such cases, this does not constitute a contract concluded outside business premises or a distance contract, as the customer can, prior to purchase, clearly verify the main characteristics of the goods or services and may withdraw from the final purchase, i.e. from concluding the contract. The contract enters into force and becomes binding at the moment the customer receives the invoice and the goods.


I) Conclusion and Termination of Sales Contracts Concluded Outside Business Premises and Distance Contracts

These Terms, as well as any individual sales conditions stated alongside information on specific products, constitute an offer by Match Fishing to conclude a Contract. By registering, completing an order, or otherwise as specified in these Terms, the user as the customer accepts them, and this is considered a request to conclude a Contract between the user and Match Fishing, under the sales conditions set out in these Terms.

The subject and commercial purpose of the Contract is the purchase of a selected product or service via the Match Fishing Web Shop with payment of the corresponding fee – the price of that product or service. The Contract is concluded using distance communication means (a distance contract), namely via: printed promotional materials with an order form, telephone with or without human mediation, and the Internet.

The Contract enters into force and becomes binding at the moment the customer receives the invoice and the goods. If the customer collects the ordered goods in Match Fishing retail stores, this does not constitute a contract concluded outside business premises or a distance contract, as the customer can, prior to purchase, clearly verify the main characteristics of the goods or services and may withdraw from the final purchase, i.e. from concluding the contract. A previously placed order does not bind the customer. The Contract enters into force and becomes binding at the moment the customer receives the invoice and the goods.

The customer has expressed the intention to conclude a purchase agreement:

  • by selecting a payment method and completing the order as a registered Match Fishing user,

  • by selecting a payment method and completing the order as a guest user,

  • by selecting a payment method and completing the order via the telephone lines of Match Fishing stores.

The Contract enters into force and becomes binding at the moment Match Fishing confirms product availability and price and, depending on the payment method, authorizes card payment, sends an official binding offer for payment by bank transfer, or sends the customer an invoice and a notice of the shipment dispatch time. The Contract does not enter into force merely by placing an order and receiving an automated system message confirming the order, because at the moment of placing the order the product availability, price, or specifications may change. Only an official binding offer or issuance of an invoice confirms the price and availability of the goods.

a) During registration or creation of a user account, the user is required to choose a username/name under which the services will be used and to choose a security password, and to provide a valid email address. All data required for registration or account creation must be true, and the use of another person’s data is expressly prohibited.
b) Registration or a user account is created for one person only, and it is not permitted to share registration/account information with third parties. The user is required to keep their password and account information confidential. Use of another person’s registration or account is not permitted.
c) In the event of a breach of the provisions of this section, Match Fishing reserves the right, at its sole discretion, to deactivate the user’s registration or user account, without any obligation to reimburse the user for any costs or damages.
d) If the customer chooses to collect the goods at a Match Fishing retail store, the Contract enters into force upon collection and payment of the goods with issuance of a physical invoice. If the customer chooses collection of the goods and invoice at a Match Fishing store, this does not constitute a contract concluded outside business premises or a distance contract.
e) If the customer chooses delivery of the goods by courier service, the Contract enters into force at the moment Match Fishing staff deliver the invoice to the customer by email, fax, or post. In that case, this is considered a contract concluded outside business premises or a distance contract.
f) After placing an order (expressing the intention to conclude the Contract), the user will receive an Order Confirmation, i.e. pre-contractual information under Article 57(1) of the Consumer Protection Act (Official Gazette No. 41/2014), these Terms, and information about the user’s right to unilateral termination of the Contract together with the unilateral termination form under Article 61(1) and (2) of the Consumer Protection Act (provided via a link if the Order Confirmation is delivered by email, or in a separate document if delivered by regular mail or fax).
h) The user may unilaterally terminate the Contract within 14 (fourteen) days without stating any reason. The user does not have the right to unilaterally terminate the Contract:

  • if the service has been fully performed and performance began with the user’s prior express consent and with their acknowledgement that they will lose the right to terminate once the service has been fully performed,

  • if the subject of the Contract is sealed goods which are not suitable for return for health or hygiene reasons, if unsealed after delivery,

  • if the subject of the Contract is goods which, due to their nature, are inseparably mixed with other items after delivery,

  • if the subject of the Contract is the delivery of sealed audio or video recordings or computer programs that were unsealed after delivery, and

  • if the subject of the Contract is the delivery of newspapers, periodicals or magazines, except for subscription contracts for such publications.

In order to exercise the right to unilateral termination, the user must notify Match Fishing of their decision to unilaterally terminate the Contract before the expiry of the deadline, by an unambiguous statement sent by post (to Optimus Lab d.o.o., Buzovečka 69, 40000 Čakovec, Croatia), by fax to +385 40 629 011, or by email to shop@matchfishing.hr, stating their name and surname, address, telephone number, fax number or email address, and they may also use the provided written form for unilateral termination.

The unilateral termination form available at the following link may be completed and submitted electronically, in which case Match Fishing will send confirmation of receipt of the termination notice by email within 1 business day:

The deadline for unilateral termination is 14 (fourteen) days from the day on which the goods that are the subject of the Contract are handed over into the possession of the user or a third party designated by the user who is not the carrier, or, in the case of services, from the conclusion of the Contract.

If the user unilaterally terminates the Contract, the refund of payments received from the user (excluding delivery costs) shall be made without delay and no later than 14 (fourteen) days from the day Match Fishing receives the user’s decision to terminate the Contract. The refund will be made using the same means of payment used by the user.

The user is required to hand over or send the goods to Optimus Lab d.o.o., Buzovečka 69, 40000 Čakovec, Croatia, without undue delay and in any event no later than 14 (fourteen) days from the day the user informed Match Fishing of their decision to unilaterally terminate the Contract. The user must bear the direct costs of returning the goods. The user is asked to contact shop@matchfishing.hr before terminating the Contract so that the return procedure can be explained.

The user is responsible for any diminished value of the goods resulting from handling, other than what was necessary to determine the nature, characteristics and functioning of the goods.

If, at the user’s request, the performance of a service began during the withdrawal period, the user is required to pay Match Fishing an amount proportional to what has been provided up to the moment the user notified Match Fishing of unilateral termination of the Contract.

3. DATA PROTECTION DURING PURCHASE

Match Fishing undertakes to respect the anonymity and privacy of users of the Match Fishing store and will use and process data exclusively for the purposes specified in these Terms. Match Fishing may collect personal data of users, such as name, address, OIB (personal identification number), telephone number or email address, only if the user voluntarily provides such data to Match Fishing.

Match Fishing will use such data exclusively for the purpose of fulfilling contractual obligations and for better insight into and understanding of individual user needs, habits and requirements, as well as for further development and higher quality provision of all Match Fishing services.

Match Fishing collects, processes and publishes data on users relating to the manner of use of the Match Fishing Web Shop without disclosing user identity and/or personal data that would enable identification.

Match Fishing collects and records the user’s IP address (Internet Protocol Address) or the location of the computer for system administration, troubleshooting, confirmation of content retrieval, and improvement of technical aspects of the internet service. Match Fishing will automatically record data on user habits when using the Match Fishing Web Shop, including log files regarding visits to certain pages and/or content. Such data will be used exclusively to improve the service and to adapt and individualize promotional activities according to the needs of the individual user.

Match Fishing does not record your credit card number and does not store transaction data. For credit card payments, Match Fishing uses a third party service provider, an authorized bank, which protects your data through encryption.

4. MATCH FISHING COMMUNICATION WITH USERS

By sending an email to shop@matchfishing.hr or subscribing to the newsletter, you give your consent for Match Fishing to inform you via email, for the purpose of promoting its services and products, about changes or additions to website content, discounts, promotions, products, or changes in the way the service is provided. The user may withdraw this consent at any time.
